Welcome to INKD Games. These Terms of Use explain the rules for visiting inkdgames.com (the “site”) and for playing the games we publish on it. Please read them. By using the site you agree to them.

1. Acceptance of the terms

By accessing or using the site, you confirm that you have read and accepted these terms. If you do not agree with them, please do not use the site. If you are under 18, please ask a parent or guardian to read these terms with you.

2. Who we are

INKD Games is an independent game studio founded in 2017 by Scarlett Lins and Rayan Garcia. In these terms, “INKD Games”, “we”, “us” and “our” refer to the studio. You can reach us at contact@inkdgames.com.

3. Using the website

You may use the site for personal, non-commercial purposes. When you use it, you agree not to:

  • break the law or violate the rights of others;
  • try to gain unauthorised access to the site, its servers or its admin area, or interfere with its operation (for example with malware, scraping at abusive rates or denial-of-service attacks);
  • use the contact form or newsletter to send spam, offensive or misleading content;
  • copy, sell or republish the site’s content in a way that suggests it comes from you or that we endorse it.

We may suspend or restrict access to the site at any time, for example for maintenance or if we suspect misuse.

4. Games and licence

The games we publish are provided on the site, on itch.io, Steam, Google Play and other stores. Unless a game page says otherwise, we grant you a personal, non-exclusive, non-transferable and revocable licence to play and enjoy the games for your own entertainment. You may not:

  • sell, rent, sublicense or redistribute the games or their files;
  • reverse engineer, decompile or extract the games’ code or assets, except where the law allows it despite this restriction;
  • use the games’ art, music, characters or names in commercial products without our written permission.

Videos, streams and reviews of our games are welcome, including monetised ones. We only ask that you credit INKD Games and link back to the game page when you can.

Games downloaded from third-party stores are also subject to the terms of that store.

5. Intellectual property

All content on the site, including texts, pixel art, illustrations, characters, logos, music, videos, game code and the INKD Games name and mascot, belongs to INKD Games or is used with permission, and is protected by copyright and trademark laws. All rights not expressly granted in these terms are reserved. Names and logos of other companies, stores and platforms belong to their respective owners.

If you believe something on the site infringes your rights, write to us at contact@inkdgames.com with the details and we will look into it promptly.

6. Messages and content you send us

If you send us a message, feedback, ideas or other material through the contact form or by email, you allow us to read and use it to reply to you and to improve our games and site. We will not publish your message or your name without asking you first. Reviews shown on game pages come from public stores or were shared with us with the author’s permission.

7. Newsletter and contact

When you subscribe to the newsletter you agree to receive occasional emails about our games, devlogs and news. You can unsubscribe at any time using the link in the emails or by writing to us. We only send messages to people who subscribed or asked to hear from us.

8. Privacy and data

We collect only what we need to run the site:

  • Contact form and email: your name, email address and message, used to reply to you.
  • Newsletter: your email address and the date you subscribed, used to send our updates.
  • Usage data: anonymous statistics about page visits (for example with Google Analytics) and, where you accept cookies, measurement tools such as the Meta Pixel. These help us understand which pages are useful.
  • Security data: technical information such as IP address and browser type, kept briefly to protect the site against abuse.

We do not sell your personal data. We share it only with the service providers that help us run the site (such as hosting, email and analytics) and when the law requires it. We keep data only for as long as needed for the purposes above.

Under the Brazilian General Data Protection Law (LGPD) and other applicable laws, you have the right to ask us to confirm that we process your data, access it, correct it, delete it, or withdraw your consent at any time. To exercise these rights, write to contact@inkdgames.com.

You can control cookies in your browser settings. Blocking some cookies may affect how parts of the site work.

9. Third-party links and stores

The site links to and embeds services we do not control, such as YouTube, Vimeo, itch.io, Steam, Google Play, Instagram and others. Their content, availability and privacy practices are their own responsibility, and their own terms apply when you use them.

10. No warranty

The site and the games are provided “as is” and “as available”. We do our best to keep everything working, but we do not promise that the site will always be available, free of errors or free of harmful components, or that the games will meet your expectations or run on every device.

11. Limitation of liability

To the extent allowed by law, INKD Games will not be liable for indirect, incidental or consequential damages that result from the use of, or the inability to use, the site or the games, including loss of data or profits. Nothing in these terms limits any right you have as a consumer that cannot be limited by law.

12. Changes to these terms

We may update these terms from time to time, for example when we launch new features. The “Last updated” date at the top shows when the latest changes were made. If you keep using the site after an update, you accept the new version.

13. Governing law

These terms are governed by the laws of Brazil. Any dispute will be handled by the courts of Brazil, without prejudice to the consumer rights that apply where you live.
